1. Introduction

Welcome to Bowsmith. These Terms of Service ("Terms") govern your use of the Bowsmith mobile application ("App"), developed and operated by Michał Buczko, sole proprietorship based in Poland ("we", "us", "our").

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Service Description

Bowsmith is an archery companion app designed to help archers track, organize, and analyze their practice sessions, competitions, equipment, and tuning activities. The App provides:

• Practice and competition session logging
• Equipment and gear tracking
• Tuning and setup record-keeping
• Performance analytics and statistics
• Data synchronization across your Apple devices via iCloud

Bowsmith is a tracking and organizational tool. It does not provide coaching, safety instructions, or medical advice.

3. Eligibility

The App is rated 4+ and is suitable for all ages. No account registration is required. If you are under 18, you should have your parent or guardian's permission before using the App.

4. User Responsibilities

By using the App, you agree to:

• Provide accurate information when entering data (equipment specs, scores, measurements)
• Use the App in compliance with all applicable laws
• Follow all safety rules at your archery range or venue — the App does not replace safety protocols
• Not attempt to reverse-engineer, decompile, or tamper with the App
• Not use the App for any unlawful or harmful purpose

Equipment safety: Bowsmith tracks your equipment data for informational purposes only. Always follow your equipment manufacturer's guidelines and consult qualified professionals for equipment setup and safety decisions.

5. Limitations of Liability

To the fullest extent permitted by applicable law:

• The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose or accuracy of data.
• Bowsmith is not safety equipment. The App does not monitor, verify, or guarantee the safety of your archery equipment. You are solely responsible for the safe use and maintenance of your equipment.
• No guarantee of performance improvement. While the App helps you track and analyze your archery activities, we make no guarantees regarding improvement in performance or scores.
• We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App, including but not limited to personal injury, equipment damage, or data loss.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under EU consumer protection regulations.

6. Privacy and Data

Your privacy is important to us. Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms.

Key points:

• Your data belongs to you. All session data, equipment records, and statistics you enter are yours.
• iCloud synchronization. If you use iCloud, your data is synced via Apple's CloudKit service and is subject to Apple's iCloud Terms. We do not have direct access to your iCloud data.
• Local storage. If you do not use iCloud, your data is stored locally on your device.
• Data deletion. You can delete your data at any time from within the App. Uninstalling the App will remove locally stored data.
• Analytics. We collect anonymous, privacy-friendly usage analytics to improve the App. See our Privacy Policy for details.

7. Account and Access

• iCloud account. An Apple ID with iCloud enabled is required for cross-device data synchronization. This is optional — the App functions fully without iCloud.
• Service availability. We strive to keep the App functional and up to date, but we do not guarantee uninterrupted availability. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• Updates. We may release updates to improve functionality, fix issues, or comply with platform requirements. Continued use after an update constitutes acceptance of any changes.

8. Subscriptions and Purchases

Bowsmith may offer optional in-app purchases or subscriptions for premium features. If applicable:

• Purchases are processed by Apple through the App Store and are subject to Apple's Terms of Service.
• Subscription management and cancellation are handled through your Apple ID settings.
• Refund requests should be directed to Apple, as we do not process payments directly.

9. Intellectual Property

• App ownership. Bowsmith, including its design, code, graphics, and content, is the intellectual property of Michał Buczko and is protected by applicable copyright and intellectual property laws.
• Your content. You retain ownership of all data you enter into the App. By using the App, you grant us a limited license to process your data solely to provide App functionality.
• Third-party components. The App uses open-source libraries and third-party components, each subject to their respective licenses. Acknowledgments are available within the App settings.

10. Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, legal requirements, or our practices. When we make changes:

• The "Last updated" date at the top will be revised.
• For significant changes, we will notify you through the App or via the App Store update notes.
• Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

• These Terms are governed by and construed in accordance with the laws of the Republic of Poland.
• Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Poland.

EU consumer rights. If you are a consumer residing in the European Union, nothing in these Terms affects your rights under mandatory EU consumer protection legislation, including Directive 2011/83/EU on consumer rights. You may also be entitled to use the EU Online Dispute Resolution platform.

12. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to discontinue the App or restrict access if these Terms are violated, with reasonable notice where possible.
